互联网平台企业涉税信息报送规定

 《互联网平台企业涉税信息报送规定》及相关公告对互联网平台企业的涉税信息报送作出了明确规定，以下是主要内容：一、报送主体

1.适用平台类型

包括网络商品销售平台、网络直播平台、网络货运平台、灵活用工平台等八类互联网平台企业，涵盖当前平台经济主要领域。

2.责任主体确定

境内平台有多个运营主体时，按以下顺序确定报送企业：取得增值电信业务经营许可证的企业、办理互联网信息服务备案的企业、提供网络经营场所等营利性服务的企业。境外平台在境内设立运营主体的，由取得增值电信业务经营许可证的境内企业报送；未设立运营主体的，由境外平台指定境内代理人报送。二、报送内容

1.平台企业基本信息

包括企业名称、统一社会信用代码、增值电信业务经营许可证信息、平台信息及运营主体信息等。

2.平台内经营者和从业人员身份信息  

· 已取得登记证照的经营者需报送名称、统一社会信用代码、地址等信息。  

· 未取得登记证照的需报送姓名、证件类型、证件号码等信息。  

· 网络直播平台需额外报送《平台内的直播人员服务机构与网络主播关联关系表》。  

· 为小程序、快应用等提供基础架构服务的平台，需报送《平台内的平台企业身份信息报送表》。

3.平台内经营者和从业人员收入信息

包括上季度销售货物、服务、无形资产取得的收入（含收入总额、退款金额、收入净额）、从事其他网络交易活动取得的收入及交易数量。境外平台需报送平台内境外经营者和从业人员向境内销售服务、无形资产的收入信息，单个境内购买方季度累计交易净额不超过5000元的可暂不报送。

4.网络主播及合作方涉税信息

通过互联网平台取得直播相关收入的平台内经营者（自然人除外），需报送网络主播及合作方的身份信息和收入信息。三、报送时间与方式

1.报送时间  

· 基本信息：自从事互联网经营业务之日起30日内报送，信息变化的自变化之日起30日内报送。  

· 身份信息和收入信息：季度终了的次月内报送。  

· 首次报送：2025年7月1日至30日报送平台企业基本信息，10月1日至31日首次报送平台内经营者和从业人员的身份信息、收入信息。

2.报送渠道

可通过电子税务局、数据接口直连或税务机关提供的其他渠道报送。四、法律责任

1.未按规定报送的处罚

未按期限报送、瞒报、谎报、漏报涉税信息或因自身原因导致信息不真实、不准确、不完整的，由税务机关责令限期改正；逾期不改正的，处2万元以上10万元以下罚款；情节严重的，责令停业整顿，并处10万元以上50万元以下罚款，相关情形纳入纳税缴费信用评价管理，一个年度内2次以上未按规定报送的，税务机关可向社会公示。

2.信息真实性责任

平台企业需核验涉税信息真实性、准确性、完整性，因平台内经营者或从业人员过错导致信息问题的，平台企业不承担责任。五、免予报送情形

1.在互联网平台内从事配送、运输、家政等便民劳务活动的从业人员的收入信息。  

2.平台内经营者和从业人员在规定施行前的涉税信息。以上规定旨在规范平台经济税收秩序，促进公平竞争，平台企业需严格遵守报送要求，确保涉税信息真实、准确、完整。
